Terms of Service

1. Acceptance of Terms

By downloading, installing, or using Jumble ("the App", "the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you must not use the App.

These Terms constitute a legally binding agreement between you and Soban Rafiq ("Developer", "we", "us", "our"). We reserve the right to update these Terms at any time. Continued use of the App after changes constitutes your acceptance of the updated Terms.

2. Description of Service

Jumble is a personal financial ledger and budget management application. It allows users to record credit and debit transactions between informal contacts ("Khatas"), track personal expenses, and manage budgets.

The App is provided for personal, non-commercial record-keeping and convenience only. It is not a bank, financial institution, payment processor, money services business, or accounting firm, and is not regulated as such in any jurisdiction.

3. Eligibility & Age Requirements

General: You must be at least 13 years of age to use the App.

EU/EEA Users: If you are located in the European Union or European Economic Area, you must meet the minimum age for digital consent in your country. In most EU member states this is 16 years; in some it is lower (minimum 13). You are responsible for complying with your local age requirements.

Parental Consent: If you are between the applicable minimum age and 18, your parent or legal guardian must agree to these Terms on your behalf.

Capacity: By using the App, you represent that you have the legal capacity to enter into this agreement in your jurisdiction.

4. Non-Official & Non-Legal Use

IMPORTANT: Jumble is NOT a professional accounting, auditing, legal, or financial advisory service. You MUST NOT use the App for:

  • Any official, legal, tax, audit, or regulatory compliance purpose.
  • Evidence in legal proceedings or disputes.
  • Any purpose that requires certified or legally-recognised financial records.
  • Operating as a money services business, payment processor, or financial institution.

Records created in Jumble are for informal reference only and carry no legal weight or official standing in any jurisdiction.

5. User Accounts

  • You must provide accurate, complete, and current information when creating an account.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You must notify us immediately if you suspect unauthorised access to your account.
  • You are solely responsible for all activity that occurs under your account.
  • One phone number may only be linked to one account. Phone numbers are permanent and cannot be changed after registration.
  • You may not create accounts for others without their consent, or impersonate any person.

6. Acceptable Use

You agree NOT to:
  • Use the App for any illegal, fraudulent, or unauthorised purpose.
  • Enter false, misleading, or fabricated transaction data with the intent to deceive another person.
  • Attempt to gain unauthorised access to another user's account or data.
  • Interfere with or disrupt the App's servers, infrastructure, or other users' access.
  • Reverse engineer, decompile, or attempt to extract the App's source code.
  • Use the App to harass, defame, or threaten any person.
  • Violate any applicable local, national, or international law or regulation.
  • Use automated tools (bots, scrapers) to interact with the App.

7. Shared Khata Feature

Jumble allows you to create a Shared Khata with another registered user. When you do:

  • Both participants can view and add transactions to the shared record.
  • You are responsible for the accuracy of all information you enter.
  • Jumble does not mediate, verify, or adjudicate financial disputes between users.
  • You must have the other person's consent before adding their phone number to a Shared Khata.
  • Shared Khata data may be visible to the other participant. Do not enter information you wish to keep private.

8. Data Accuracy & User Responsibility

Jumble is an informal record-keeping tool. It does not:

  • Verify the accuracy, completeness, or validity of transactions.
  • Verify the identity of users or their contacts.
  • Guarantee that records are free from errors, data loss, or corruption.

You are solely responsible for all entries, calculations, decisions, and outcomes arising from your use of the App. Any financial decisions made based on App records are entirely at your own risk.

9. Intellectual Property

The Jumble name, logo, brand, user interface design, and original codebase are the intellectual property of Soban Rafiq and are protected by applicable intellectual property laws.

You retain ownership of all content and data you enter into the App (your ledger records, transaction descriptions, etc.). By using the App, you grant us a limited, non-exclusive licence to store and process your content solely for the purpose of providing the Service.

You may not reproduce, distribute, modify, or create derivative works from any part of the App without our express written permission.

10. Interruptions & Availability

We strive to keep the App available at all times but do not guarantee uninterrupted or error-free access. The App may be temporarily unavailable due to:

  • Scheduled or emergency maintenance.
  • Third-party service outages (e.g. Google Firebase).
  • Force majeure events beyond our control.
  • Updates required to comply with platform policies or legal requirements.

We are not liable for any loss or inconvenience caused by downtime.

11. No Warranty

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, OR NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SOBAN RAFIQ SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of data, profits, goodwill, or use.
  • Financial losses arising from decisions made based on App records.
  • Disputes between users of the App.
  • Security breaches caused by factors outside our reasonable control.

WHERE APPLICABLE LAW DOES NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OF LIABILITY, OUR LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY SUCH LAW.

In jurisdictions that do not allow limitation of liability for consumers (including certain EU member states), the above limitations apply only to the extent permitted by law.

13. Indemnification

You agree to indemnify, defend, and hold harmless Soban Rafiq from and against any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from:

  • Your use or misuse of the App.
  • Your violation of these Terms.
  • Your infringement of any third-party rights.
  • Any false or misleading information you have entered into the App.

14. International Use

The App is available globally (subject to applicable laws and platform availability). By accessing the App from outside Pakistan, you are responsible for ensuring your use complies with your local laws and regulations.

The App may not be appropriate or available in all countries due to local laws, sanctions, or app store restrictions. We make no representation that the App is appropriate for use in every jurisdiction.

The App is currently available in English only. Currency symbols and phone country codes are automatically matched to your location.

15. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Islamic Republic of Pakistan, without regard to its conflict-of-law provisions.

For users located in the European Union: Nothing in these Terms limits your rights under the mandatory consumer protection laws of your country of residence, which shall apply to the extent required by applicable EU law.

For users located in the United Kingdom: These Terms do not affect your statutory rights as a UK consumer.

For users located in Australia: These Terms do not exclude, restrict, or modify rights conferred by the Australian Consumer Law that cannot be lawfully excluded.

For users located in California, USA: These Terms do not limit any rights expressly granted to you under the California Consumer Privacy Act (CCPA) or the California Privacy Rights Act (CPRA).

For users located in Saudi Arabia or the UAE: These Terms shall be interpreted in harmony with applicable GCC PDPL regulations. Any conflict between these Terms and mandatory PDPL provisions shall be resolved in favour of PDPL-mandated user rights.

Subject to the dispute resolution clause below, you agree that any legal action or proceeding shall be brought exclusively in the courts of Pakistan, and you consent to the personal jurisdiction of such courts.

16. Dispute Resolution

We prefer to resolve disputes amicably. Before initiating any formal proceeding:

Step 1 — Informal Resolution: Contact us at contact@jumbleapp.online with a description of your dispute. We will attempt to resolve it within 30 days.

Step 2 — ODR (EU Consumers): If you are an EU consumer and informal resolution fails, you may use the European Commission's Online Dispute Resolution (ODR) platform at ec.europa.eu/consumers/odr.

Step 3 — Arbitration: If informal resolution fails, disputes shall be submitted to binding arbitration administered in accordance with the UNCITRAL Arbitration Rules. The place of arbitration shall be mutually agreed upon, and the language of arbitration shall be English.

Step 4 — Courts: Either party may seek injunctive or other equitable relief from a court of competent jurisdiction where arbitration is not available or cannot provide adequate remedy.

California consumers: Nothing in this section limits your right to bring a claim in small-claims court. California consumers may report concerns regarding privacy violations to the California Privacy Protection Agency at cppa.ca.gov.

17. Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, if you:

  • Violate these Terms or our Privacy Policy.
  • Engage in fraudulent, abusive, or illegal activity.
  • Pose a security risk to other users or the platform.

You may delete your account at any time via Settings → Danger Zone → Delete Account. Upon deletion, all your data is permanently removed.

Sections 8, 9, 11, 12, 13, 15, and 16 survive termination of these Terms.

18. Changes to Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date and, where feasible, notify you in the App. Your continued use after changes constitutes acceptance.

If you do not accept the updated Terms, you must stop using the App and delete your account.
